TERMS AND CONDITIONS
Client terms of business for the introduction of an applicant to a client should they engage the applicants services shall be subject to the following terms and conditions.
DEFINITIONS
1. In these Terms of Business the following definitions apply:
"Agency" means Jo Munro childcare of 29 St Swithin street, Aberdeen, AB10 6XB.
"Applicant" means the person introduced by the Agency to the client for an engagement.
"Client" means the person, family or company to whom the Applicant is introduced.
"Engagement" means the engagement, employment or use of the Applicant by the client or any third party on a permanent or temporary basis, whether under a contract of service or any other engagement.
1.2 Unless the context requires otherwise, references to the singular include the plural and vice versa.
1.3 The headings contained in these Terms and Conditions are for convenience only and do not affect their interpretation.
FEES
2. The client shall pay the agency fee to the agency should an applicant who has been introduced to the client by the Agency be engaged or employed by the client.
2.2 Should the client choose to engage an applicant either verbally or in writing a standard fee equal to four weeks of the applicants net salary will be due to the agency within seven days of the invoice date.
2.3 The agency fee for temporary applicants, 10 weeks or less,is £75 per week. Should the applicant become permanently employed, more than ten weeks, the full agency fee will apply.
2.4 The client shall notify the agency immediately of any offer of engagement made to the applicant by the client or any third party.
2.5 A fee will be due by the client to the agency should they engage an applicant within a 12 month period from the date of introduction.
2.6 Prior to the commencement of the engagement, unless agreed otherwise in writing, the agency will invoice the client for the agency fee. The invoice shall be due and payable within seven days. If the client chooses to pay after seven days then a 10% surcharge shall be added to the agency fee every seven days.
2.7 The interviewing and subsequent engagement of an applicant is deemed to be acceptance of these terms and conditions and fees.
PLACEMENTS
3. If an applicant engaged by the client does not remain engaged by the client for at least four weeks, the agency will provide a refund excluding a £195 administrative fee, if the terms and conditions have been met and;
3.1.1 The client notifies the agency within two business days of the applicants termination in writing.
3.1.2 The terms of engagement have not been changed by the client
3.1.3 Should the client find the applicant unsuitable and still engages the applicant.
If the client has not met the above conditions to the agency, the client is responsible for full payment of the initial placements invoice and the agency will offer no refund to the client.
3.2 The agency agrees to refund a client in full if an applicant reneges on an engagement (subject to the terms and conditions).
3.3 The agency acts as a means of introduction only for the placement of domestic staff. The agency endeavours to ensure the suitability of the applicant introduced to the client.
3.4 The client shall satisfy itself as to the suitability of the applicant and takes responsibility to ensure the accuracy of the details and documents supplied by the applicant.
3.5 The client is responsible for obtaining work and other permits, if so required.
3.6 The client is responsible for ensuring they have employers liability insurance in place for any applicant they employ.
3.7 The client is required to reimburse all reasonable travelling expenses to any applicants upon presentation of a receipt.
The agency cannot be held responsible for any losses, costs, claims or damages or liabilities to the client and/or the children of any client or to the clients property or to the applicant arising from the introduction or engagement of applicants.
Jo Munro childcare reserves the right to review and revise these terms and conditions without prior notification.
LAW
These terms and conditions of business are governed by the law of England, Scotland, Wales and Northern Ireland and are subject to the exclusive jurisdiction of the Courts of England, Scotland, Wales and Northern Ireland.
